Welcome to Luxtrium. These Terms of Service ("Terms") govern your access to and use of the website www.luxtrium.com (the "Site"), operated by Luxtrium L.L.C. ("Luxtrium," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to all of these Terms, do not access or use the Site.

1. Use of the Site

2. SMS Text Messaging Program

By providing your mobile phone number and opting in through the Site, a form, or another Luxtrium touchpoint, you consent to receive text messages from Luxtrium at the number provided. This program is separate from any email communications you may also receive.

What you'll receive. Messages may include booking and tour confirmations, event reminders, venue availability updates, and promotional offers related to Luxtrium's event and venue services.

Message frequency. Message frequency varies based on your interactions with us and any upcoming bookings or events.

Message and data rates. Message and data rates may apply. Charges depend on your mobile carrier and plan.

Opting out. You can opt out of text messages at any time by replying STOP to any message you receive from us. You will receive a one-time confirmation that you have been unsubscribed, and no further messages will be sent unless you opt in again.

Help. For help at any time, reply HELP to any message, email us at [email protected], or call (832) 380-8567.

Carrier liability. Carriers are not liable for delayed or undelivered messages. Luxtrium is not responsible for delays or failures in message delivery caused by your carrier or mobile device.

Eligibility. You must be 18 years of age or older to opt in to this program. By opting in, you represent that you are at least 18 years old and are the account holder or have the account holder's permission to provide the mobile number.

Consent is not a condition of purchase. Opting in to text messages is never required to book a tour, attend an event, or use

Luxtrium's services.

3. Intellectual Property Rights

The Site and its entire contents, features, and functionality — including all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement of that material — are owned by Luxtrium, its licensors, or other providers of such material, and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

4. User Contributions

The Site may contain message boards, chat rooms, forums, or other interactive features (collectively, "Interactive Services") that allow users to post, submit, publish, display, or transmit content or materials to other users or other persons (collectively, "User Contributions").

All User Contributions must comply with the Content Standards set out in Section 5 below. Any User Contribution you post to the Site will be considered non-confidential and non-proprietary. By providing any User Contribution on the Site, you grant Luxtrium, our affiliates and service providers, and each of our respective licensees, successors, and assigns the right to use, reproduce, modify, perform, display, distribute, and otherwise disclose that material to third parties for any purpose.

5. Content Standards

These Content Standards apply to all User Contributions and use of any Interactive Services. User Contributions must comply with all applicable federal, state, local, and international laws and regulations. Without limiting the foregoing, User Contributions must not:

  • Contain material that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable.

  • Promote sexually explicit or pornographic material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.

6. Termination

We may terminate or suspend your account and bar access to the Site immediately, without prior notice or liability, at our sole discretion, for any reason, including without limitation a breach of these Terms.

7. Limitation of Liability

To the fullest extent permitted by law, Luxtrium, its affiliates, and their licensors, service providers, employees, agents, officers, and directors will not be liable for any damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the Site, any websites linked to it, or any content on the Site. This includes, without limitation, any direct, indirect, special, incidental, consequential, or punitive damages, such as personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, or loss of data, whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable.

8. Governing Law

All matters relating to the Site and these Terms, and any dispute or claim arising from or related to them (including non-contractual disputes or claims), are governed by and construed in accordance with the internal laws of the State of Texas, without giving effect to any choice or conflict of law provision or rule.
